RVRA Comment:
The RVRA is not opposed to the operator's (and Residents) right to appeal a decision made by the CTTT. However, the RVRA is opposed to the naming of the residents as the defendants, which is unnecessary, unjust and gives the operators considerable coercive powers to deter the residents from exercising their legal rights. See Link 1 below. Stockland Retirement Living Appeals decision of the CTTT naming the Residents of Queens Lake Village as the Defendants. This matter arose from a dispute heard in the Consumer, Trader and Tenancy Tribunal (CTTT) on the 8th November 2010 between the Residents of Queens Lake Village at Laurieton and the operators of the village, Queens Lake Village Pty Ltd, a wholly owned subsidiary company of Aevum Limited. the CTTT found in favour of the Residents. Aevum was taken over in November 2010 by the Stockland Group and it was under the stewardship of Stockland that the matter was Appealed to the District Court. 24th May 2011: This matter has now been resolved; the Queens Lake Village Residents at a Special Budget meeting held today have approved the budget for the year 2011-12. Although the degree of detail and transparency still requires refinement it is anticipated that the information to accompany the 2012-13 budget next year will give the Residents sufficient information to enable them to make an informed decision when the matter of the village budget is next visited. |
