The AGM was held At the Central Coast Leagues Club, Gosford, on Friday 28th August 2009.

There were some 150 members in attendance.

The proceedings were disrupted by a fatal accident on the Freeway. All members attending from Sydney were greatly delayed. Therefore the meeting began half an hour later than scheduled, with many of the committee and the two guests speakers still not in attendance.

The reports were read and received.

Minister for Fair Trading the Hon Virginia Judge, Minister for Fair trading, addressed the meeting and:

       - Acknowledged of the presence of Local Member, Marie Andrews, also Julia Irwin, the Federal Member for Fowler.
       - Gave a brief history of the RVRA and acknowledged the work the Committee do in support of Residents.

       - Reported the Consultative draft of the Regulations is almost complete. Reforms to the Act are expected by the end of 2009 and the Regulations should clarify the Exit Procedure.

       - Advised Education Seminars will be held in various Centres and Regions to inform Residents as to the changes in the Act.

       - Announced that New South Wales and Victoria are to harmonise their Legislative requirements. There will be a "Working Group" established, to which the RVRA has nominated four representatives.

The Minister stated that "Her door was always open".

Agenda Item 8: The motion to amend the Constitution.
(See letter below)
This proposed motion was amended by the meeting to read:
Clause 58(1) would then read "The funds of the association are to be derived from entrance fees and annual subscriptions of members, donations, bank interest, and such other sources as the committee decides from time to time and members be so advised." This motion was then put, and carried.

New Committee for 2009–2010
Former President Len Rooney, as Returning Officer introduced the new committee.

Life Membership granted to Mr Rob Harvie and Mrs Betty Harvie.
Barbara Dillon spoke of the work done by Rob and Betty Harvie over the past 8 years and moved that they be granted Life Membership of the Association. The motion was seconded, and carried unanimously.

Ian Hooper then handed over to the new president Malcolm McKenzie, who closed the meeting at 1.10 pm.

Explanatory Note to the RVRA Annual General Meeting Minutes, held on 28th August 2009.

A report of the Annual General Meeting held on 28th August 2009 is in the September newsletter. This letter is to explain the events that occurred in and following the meeting.

Due to a serious traffic incident on the F3 Freeway, the starting time of the Annual General Meeting, was delayed to allow many members time to arrive. Unfortunately, even with the later commencement time several of the committee had not arrived, including the Secretary, causing changes to, and confusion about the agenda.

A special resolution, of which due notice had been given, was put to the meeting and carried, although a count was not taken as required by the Constitution. This resolution must therefore be considered invalid.

In addition, a motion put earlier in the meeting, which provided for the suspension of standing orders regarding the number of proxies to be allowed, was carried, but this was also unconstitutional, and therefore invalid.

The formal proxy form and its conditions have also been questioned. The proxy form distributed to members was as prescribed in Appendix 1 of the Constitution. The subcommittee, currently considering revisions to the Constitution, will look at the proxy provisions at the same time as other constitutional changes. The Management Committee will therefore be recommending some changes to the proxy provisions and the current form.

All other resolutions passed at the meeting were in accordance with the Constitution and are therefore legal and valid.

The committee has resolved that the appropriate action is to call a Special General Meeting early in 2010 to vote on several constitutional matters including the above. All members will be advised well in advance of the date and of the special resolutions to be put at that meeting.
